General Terms and Conditions for monthly donations under BLAGODETEL programme of UNICEF Bulgaria

DEFINITIONS
1.1. UNICEF is an international intergovernmental organization set up by the UN General Assembly by Resolution No. 57(I) of 11 December 1946 as an auxiliary body to the United Nations, represented by Maria Jesus Conde, Representative to Bulgaria, and address in Bulgaria: Sofia 1000, 87 Aleksandar Dondukov Blvd, floor 2.
1.2. “BLAGODETEL” initiative is a programme for monthly donations in support for UNICEF’s work around the world and the projects in Bulgaria described on UNICEF’s website www.unicef.bg.
1.3. “BLAGODETEL” individual (the PLEDGE DONOR) is a person donating on a regular monthly basis a fixed amount for at least 12 consecutive months in support of UNICEF Bulgaria’s activities.
1.4. “Donation Methods” are the methods for making individual monthly donations set out in accordance with these General Terms and Conditions.
1.5. An “Agreement for Payroll Donation” is a contract concluded following a form (Annex 1) between UNICEF and the PLEDGE DONOR for participation in the BLAGODETEL initiative.
2. GENERAL PROVISIONS
2.1. In accordance with its Articles of Association and its Mission, UNICEF works with governments, civil society organizations and other partners in more than one hundred and sixty countries to promote the rights of the child to life, protection, development and participation and is guided by the Convention on the Rights of the Child.
2.2. UNICEF has the right to receive funds from private individuals to support its work and it has developed the regular donation programme BLAGODETEL for this purpose.
2.3. The PLEDGE DONOR agrees to support the projects of UNICEF Bulgaria. UNICEF, on its part, gratefully recognizes the PLEDGE DONOR’s desire to help in its work in accordance with the terms and conditions of the individual contract for donation for participation in the BLAGODETEL initiative.
2.4. The BLAGODETEL initiative is coordinated and implemented under the guidance of UNICEF in accordance with the approved country programme 2013 – 2017 approved by UNICEF’s Executive Board and the Government of the Republic of Bulgaria. The BLAGODETEL initiative is supported by the PLEDGE DONOR via donation methods set out in these General Terms and Conditions.
3. FUNDING. DONATION METHODS
3.1. Donations via payroll
3.1.1. Donations as per payroll are made by deducting a set amount from the PLEDGE DONOR’s salary on a monthly basis; the amount is set by the PLEDGE DONOR and transferred to UNICEF’s bank account.
3.1.2. Donations as per payroll are made by virtue of an individual agreement for donation concluded between the PLEDGE DONOR and UNICEF following a template – Annex 1. The template agreement for payroll donations is available at www.unicef.bg
The PLEDGE DONOR provides to the Employer a copy of the Agreement for payroll donation with UNICEF.
3.1.3. The Employer deducts the amount of individual donations indicated in the Agreement for payroll donation between the PLEDGE DONOR and UNICEF from the PLEDGE DONOR’s labour remuneration on a monthly basis and transfers it to UNICEF’s bank account.
3.2. Automatic donations by a bank transfer.
3.2.1. Monthly donations by a bank transfer are made when the PLEDGE DONOR signs a direct debit agreement/standing order form, indicating UNICEF as the beneficiary, with a bank in which the PLEDGE DONOR has opened a checking account and sets out the amount the PLEDGE DONOR wishes to donate every month.
3.2.2. Following the activation of the service, the PLEDGE DONOR should send a copy of the signed form at UNICEF’s address: Sofia, 87 Aleksandar Dondukov Blvd, floor 2 or via e-mail to ppetkova@unicef.org.
3.2.3.After expiration of the duration of the direct debit/standing order, the monthly donations are not renewed automatically. The PLEDGE DONOR could renew in person the donations and sign new direct debit agreement/standing order form.
3.2.4. The amounts of donations under Section 3 are transferred to one of the following accounts of UNICEF depending on the funding method selected:

Payments are made in Bulgarian levs (BGN).
3.2.5. The PLEDGE DONOR may change the amount of the monthly donation by visiting his bank.
3.2.6. The PLEDGE DONOR may terminate the monthly donation under BLAGODETEL initiative by visiting his bank.
3.3 Online donations and donations via mobile devices
3.3.1. Online donations under the BLAGODETEL programme are made at www.unicef.bg via two web-based online payment platforms (ePay.bg and Gate 2 Shop). The PLEDGE DONOR selects donation method during his/her registration on the website.
3.3.2. Online monthly donations for registered users of ePay.bg
The registration of monthly donations is made in two consecutive steps – on the website of UNICEF Bulgaria and on the website of ePay.bg. Donations are made from a registered card or micro account through the еPay.bg system without a transfer fee.
Upon registering as a BLAGODETEL on UNICEF’s website, every PLEDGE DONOR is assigned an individual account and a unique PLEDGE DONOR number which is sent to the email the PLEDGE DONOR has indicated.
To complete the registration the PLEDGE DONOR has to log into the ePay.bg system and choose option “Register Your Utility Bills for Payment” from the Bill Payment menu. The unique PLEDGE DONOR number is entered in the Charity category against UNICEF Bulgaria.
Following the completion of the registration with ePay.bg, the PLEDGE DONOR receives monthly notification e-mails from ePay system with reminders about the payments made under BLAGODETEL initiative.
The PLEDGE DONOR may change the amount of the monthly gift by making a new registration at www.unicef.bgwith the changed amount. The PLEDGE DONOR will receive a new unique PLEDGE DONOR number and has to update it in the ePay.bg account.
The PLEDGE DONOR may skip or terminate the monthly donations, by informing UNICEF representative by phone, e-mail or mail.
3.3.3. Online automatic monthly donations through ePay.bg platform (3D terminal)
The registration of monthly donations is made in two consecutive steps – (1) on the website of UNICEF Bulgaria and (2) on the website of ePay.bg. Donations are made from a valid Visa or MasterCard through the ePay 3D terminal system. It’s not required the user to obtain user profileand registration in ePay.bg (unlike p. 3.3.2. of the General Terms and Conditions).
Upon registration for monthly donations on UNICEF’s website, the PLEDGE DONOR should select the desired amount for the monthly gift, method for payment “Credit/debit card” and to fill in own contact details.
To complete the registration for monthly donations the PLEDGE DONOR has to follow the link to ePay.bg, where to fill-in the required credit/debit card details and to confirm the first monthly gift.
Upon successful completion of the registration as a PLEDGE DONOR, the ePay.bg system deducts automatically the specified amount from the registered card between 1st and 10th date of every month. The transaction fee is 2% of the amount of the monthly donation.
The PLEDGE DONOR may terminate the monthly donations, by informing UNICEF representative by phone, e-mail or mail.
The PLEDGE DONOR may change the amount of the monthly donations by, firstly terminate the active subscription as described above, secondly by making a new registration for the desired amount following the steps in the beginning of p. 3.3.3.
3.3.4. Online automatic monthly donations through Gate2Shop platform
The registration of monthly donations is made in two consecutive steps – on the website of UNICEF Bulgaria and on the website of Gate 2 Shop where payment details are filled in.
Monthly donations are made via credit or debit card VISA Electron and MasterCard through the Gate2Shop system. Upon completion of the registration as PLEDGE DONOR in Gate2Shop, the amount of monthly gift set by the PLEDGE DONOR is transferred automatically every month to UNICEF Bulgaria on the date of initial registration. The transaction fee is 2% of the monthly donation + EUR 0.15.
The PLEDGE DONOR may terminate the monthly donations, by informing UNICEF representative by phone, e-mail or mail.
The PLEDGE DONOR may change the amount of the monthly donations by, firstly terminate the active subscription as described above, secondly by making a new registration for the desired amount following the steps in the beginning of p. 3.3.4.
3.3.5. Online donations are made in accordance with the General Terms and Conditions for the Use of the Online Payment Systems of еPay.bg and Gate2Shop.
3.3.6. Donations via mobile devices with operating systems iOS и Android.
Users of mobile devices with operating systems iOS и Android are able to make monthly donations via UNICEF Bulgaria mobile application. The application is available for download free of charge from Google Market and App Storе. Further information about UNICEF mobile application is available here.
Users of the mobile application are able to make online donations with credit/debit card VISA Electron andMasterCard through Gate2Shop payment platform. Donations via mobile devices are made in accordance with 3.3.4. of the General Terms and Conditions.
3.4. Donations by special cobranded credit card issued by Piraeus Bank
3.4.1. The PLEDGE DONOR may obtain a PLEDGE DONOR credit card from Piraeus Bank with which 10 stotinki are donated with every purchase made and the Bank adds 20 stotinki for children at a disadvantage under UNICEF’s BLAGODETEL programme.
3.4.2. A PLEDGE DONOR credit card is issued and provided to the PLEDGE DONOR in accordance with the General Terms and Conditions of Piraeus Bank.
3.5. MonthlydonationsviaSMStoshortnumber 1021
3.5.1. Registration
Private individuals are able to contribute monthly under BLAGODETEL programme 2 or 5 BGN via SMS. Registration as PLEDGE DONOR via mobile phone is made by sending SMS with text 2 or 5 to short number 1021. The billing is conducted at the moment of registration.
Following registration, the PLEDGE DONOR receives confirmation SMS with thank you message. The message clearly indicates the amount of the monthly donation and information for termination of the monthly gifts under BLAGODETEL programme.
3.5.2. Price and value of the donation
There are two options for monthly donation via SMS - of 2 BGN or 5 BGN. For customers on contract of all mobile operators in Bulgaria VAT and taxes are not added to the value of the donation SMS. VAT is added to the value of the donation SMS only for users of prepaid mobile services. Therefore the price of the donation SMS for the users of prepaid services (including VAT) is 2,40 BGN or 6,00 BGN.
3.5.3. Monthly donations
The monthly billing is conducted viaMT mechanism (Mobile Terminated or Event Charge). The system initiates billing by sending SMS (Renewal billing notification) to the PLEDGE DONOR every month with confirmation for their monthly gift. Thus the PLEDGE DONOR is always informed about the billing time and value. The amount is added to the PLEDGE DONOR’s bill for mobile phone.
3.5.4. Communication and reporting to PLEDGE DONORs
Through the monthly charging SMS the PLEDGE DONOR receives a link to the UNICEF’s Bulgaria website, where detail information about the spending of the donated amounts and the results of the campaigns, illustrated with texts, photos and videos is posted. UNICEF reserves the right to contact the PLEDGE DONORS for details about the programme.
3.5.5. Cancellation and change of monthly donation via SMS
The PLEDGE DONOR may cancel their monthly donation at any moment by sending SMS with text “S” or “STOP” to short number 1021. The SMS for cancellation is charged as standard SMS as per the plan of the mobile operator.
The PLEDGE DONOR may change the amount of the monthly donation from 2 to 5 BGN or vice versa by sending respectively digit 2 or 5 to 1021. The SMS for change is not charged as a donation SMS. The change enters into force with the next billing cycle.
5. USE OF THE FUNDS
5.1. The funds provided by the PLEDGE DONOR for the BLAGODETEL initiative will cover programme and administrative expenses of UNICEF. The funds will be used in accordance with the Financial Rules and regulations, standards and practices of UNICEF.
6. COMMUNICATION AND REPORTING
6.1. The PLEDGE DONOR provides their personal data voluntarily and agrees that UNICEF will process and store them in relation to the implementation of the BLAGODETEL initiative. Should there be any changes in the correspondence and contact information provided, the PLEDGE DONOR will notify UNICEF forthwith.
6.2. UNICEF undertakes to send the PLEDGE DONOR information about its activities and the use of the funds donated on an ongoing basis and following the end of every year by post and/or email at the addresses given by the PLEDGE DONOR. Up to date information about UNICEF’s activities is available on the website www.unicef.bg.
6.3. The PLEDGE DONOR agrees to receive information from UNICEF about UNICEF’s work by post, e-mail and phone at the addresses provided by the PLEDGE DONOR.
6.4. According to art. 22., p. 1., 1., letter o) from the Personal income tax act, the PLEDGE DONOR has the right of tax relief up to 5% of the sum of the annual tax bases for donations in UNICEF’s name. Thus UNICEF issues to the PLEDGE DONOR, by request, a yearly tax certificate for the donations received in the past year for the BLAGODETEL initiative. The certificate can be requested from the Contact persons in art. 11 of this General terms
7. PUBLIC PRESENTATION OF THE BLAGODETEL INITIATIVE
7.1. The PLEDGE DONOR agrees that no communication materials related to the PLEDGE DONOR’s contribution to BLAGODETEL initiative will be developed, produced or disseminated, without acquiring explicit written consent from UNICEF.
7.2. The PLEDGE DONOR shall not use in any way the BLAGODETEL logo, without acquiring explicit written consent from UNICEF.
7.3. UNICEF shall cover the PLEDGE DONOR’s contribution in an appropriate way in its information materials, public appearances and other appropriate ways.
8. UNICEF’s RESPONSIBILITIES
8.1. UNICEF will carry out the programme activities as they are described in UNICEF’s BLAGODETEL initiative.
9. USE OF UNICEF’s NAME AND LOGO
9.1. The PLEDGE DONOR shall not use in any way UNICEF’s logo or UNICEF’s name or any parts of it in relation to the PLEDGE DONOR’s activities or anything related to them.
9.2. UNICEF will report the contribution made to its Executive Board in accordance with its standard procedures regarding contributions from private PLEDGE DONORs. UNICEF will make every effort to give the respective recognition of the contribution in other documents as well where it deems it appropriate but the manner of any such recognition will be determined by UNICEF solely.
9.3. The PLEDGE DONOR shall not abuse, fail to comply with or commit other violations of UNICEF’s right to designation. This provision shall remain valid even after the elapse of the term or the advance termination of the individual contract for donation for participation in BLAGODETEL initiative.
10. DECLARATIONS AND RESPONSIBILITIES
10.1. The PLEDGE DONOR is responsible and guarantees to UNCIEF that neither the PLEDGE DONOR nor an individual or a legal entity that the PLEDGE DONOR controls or is controlled by the PLEDGE DONOR or that is under joint control with the PLEDGE DONOR: а) takes part in the sale or production of anti-personnel mines, or b) uses child labour in carrying out its economic operations. The PLEDGE DONOR recognizes and agrees that any violation of this provision is a violation of an essential term under the individual contract for donation for participation in the BLAGODETEL initiative which gives UNICEF the right to terminate the latter immediately by a written notice to the PLEDGE DONOR.
11. ADDRESS AND CONTACT PERSONS IN RELATION TO THE BLAGODETEL INITIATIVE

12. DURATION AND TERMINATION OF THE MONTHLY DONATIONS UNDER BLAGODETEL INITIATIVE
12.1. The PLEDGE DONOR agrees to participate in BLAGODETEL initiative with monthly donations for a minimum of 12 consecutive months.
12.2. The PLEDGE DONOR has the right to terminate the monthly donations before the date set in art. 12.1. with the obligation to stop all representative and public activities in relation to the BLAGODETEL initiative.
12.3. If the PLEDGE DONOR stops making individual monthly donations under the BLAGODETEL Programme via a direct debit/standing order by a bank or via the online payment systems еPay.bg and Gate2shop.com, the PLEDGE DONOR is responsible to notify UNICEF communicating it orally or in writing to the contact person indicated in art. 12. of the General Terms and Conditions. The options for terminating the monthly donations are described for every single donation method in art. 3. FUNDING. DONATION METHODS from the General terms and conditions.
12.4. If the PLEDGE DONOR stops their monthly donations under BLAGODETEL programme the total amount of the contributions is not refundable by UNICEF to the PLEDGE DONOR.
13. DISPUTE RESOLUTION
13.1. UNICEF and the PLEDGE DONOR make the best efforts to achieve an amicable agreement in the event of challenges, disputes, claims or complaints arising in relation to or referring to the individual contract for donation for participation in the BLAGODETEL initiative.
13.2. If UNICEF and the PLEDGE DONOR want to have their dispute resolved in a conciliation procedure, it will be held in accordance with the Conciliation Rules of the United Nations Commission on International Trade Law (UNCITRAL) or another procedure which may be agreed upon.
13.3. Any challenge, dispute, claim or complaint which is not resolved by an amicable agreement within 60 (sixty) days after UNICEF or the PLEDGE DONOR receives a request for an amicable agreement of the dispute will be referred by any party for Arbitration in accordance with the existing Arbitration Rules of United Nations Commission on International Trade Law (UNCITRAL). The parties are obligated to execute the arbitration decision as the final settlement of such a dispute. The procedure costs will be divided in equal between them. In no circumstances UNICEF bears any responsibility for any indirect, incidental or causal damages or losses of income or benefits. The Arbitration Court does not have the powers to impose punitive damages exceeding the damages suffered in reality. The Arbitration Court does not have the powers to impose an annual interest rate exceeding four percent (4%) simple and not compounded interest. As indicated, UNICEF means UNICEF and UNCITRAL means the United Nations Commission on International Trade Law. This paragraph does not prevent UNICEF from enforcing its rights in relation to its name, logo and signage by means different from arbitration.
14. PRIVILEGES AND IMMUNITY
14.1. Nothing from or in relation to the individual contract for donation for participation in the BLAGODETEL initiative may be deemed a rescission, direct or implied, of any privilege or immunity of the United Nations or UNICEF laid down in the Convention of the Privileges and Immunities of the United Nations or other documents and no provision of the General terms and conditions for participation in the BLAGODETEL initiative may be interpreted or applied in a way or in a degree which fails to comply with these privileges and immunities.
15. OTHER PROVISIONS
15.1. Upon participating in the BLAGODETEL initiative, the PLEDGE DONOR accepts these General terms and conditions and agrees to abide them according their last version, placed on UNICEF’s Bulgaria website www.unicef.bg.
15.2. UNICEF has the right to amend these General terms and conditions and to update their last version on the organization’s website.
15.3. The PLEDGE DONOR guarantees that no employee of UNICEF has received nor will be offered to receive any direct or indirect benefits arising from the participation of the PLEDGE DONOR in the BLAGODETEL initiative.
15.4. The PLEDGE DONOR will abide by all laws, regulations and rules related to the fulfilment of the obligations under these General terms and conditions for participation in the BLAGODETEL initiative.
15.5 The PLEDGE DONOR does not have the right to assign, transfer or in any other way provide his rights, claims or responsibilities for the participation in the BLAGODETEL initiative unless with the prior written consent of UNICEF.
15.6. These General Terms and Conditions were approved on 10 December 2010 and published on UNICEF’s website on 15 December 2010. Amendments to the General Terms and Conditions were approved on 30 June 2013 and published on UNICEF’s website on 09 July 2013. Second amendments to the General Terms and Conditions were approved on 19 August 2014 and published on UNICEF’s website on 20 August 2014.
