Review of Judicial Practice in Cases on Crimes against Sexual Freedom and Sexual Inviolability of Children in the Republic of Tajikistan

This policy brief presents the key findings of a review of judicial practice in Tajikistan related to crimes against the sexual freedom and sexual inviolability of children for the period 2022–2024. The review analyzes court statistics and selected criminal cases under Articles 138–142 of the Criminal Code of the Republic of Tajikistan, which criminalize rape, violent sexual acts, coercion to sexual acts, sexual intercourse with persons under sixteen years of age, and indecent acts.

The analysis identifies several important trends and systemic challenges. The number of cases related to sexual crimes against children has increased during the period under review. Most victims are girls under the age of sixteen, although the number of male victims has also increased in recent years. Many perpetrators are individuals known to the child, including relatives, neighbors, and acquaintances.

The review also reveals shortcomings in investigative and judicial practices that may expose child victims to secondary victimization. These include repeated questioning of victims, insufficient use of child-friendly procedures, and lack of systematic psychological and legal support.

Strengthening child-friendly justice mechanisms, improving investigation and court procedures, and expanding rehabilitation services for victims are essential steps toward strengthening the protection of children from sexual violence.
