Learning Passport and Passport to Earning
Welcome to Learning Passport (“LP”) and Passport to Earning (“P2E”), two online web-based, mobile app-based, and offline education and skilling platforms and learning management systems operated by UNICEF, with support from Microsoft. They are free platforms, and you will never be asked to pay to use them. The LP and P2E are typically implemented in partnership with local UNICEF offices and government agencies in the field of Education, Sports, and Skilling in each country. In a few cases, LP/P2E also collaborate with civil society organizations, details of which are mentioned in the Annexes of our Privacy Notice.
The LP and P2E are customizable learning management platforms that are active in over 35 countries. In each LP/P2E country, partners customize the platform interface, add country and context-specific content to the platform and manage users. UNICEF country office staff and Partners that are responsible for managing the platform are referred to as ‘administrators’ in the rest of the document. If you are an LP/P2E administrator, please read the section titled “For Administrators”.
Throughout this document, we use the term “Caregiver”. Caregiver means a parent, caretaker, legal guardian, or other individual legally responsible for a child under 13 years of age using the platform.
If you are under 13 years old, we encourage you to discuss your use and engagement on this site with your caregiver and make sure that they consent to your use of this site.
These Terms of Use are an agreement between you and LP/P2E that set the rules for your interactions with our site or mobile app. Please read these Terms of Use carefully.
Your privacy is very important to us – please also read our Privacy Notice, which will explain how through the LP and P2E we collect, store, and use the information that you provide to us. By using these platforms, you are confirming to us that you are agreeing to our Privacy Notice. If you are under 16 years old, please talk to your caregiver who are caring for you, and make sure that they agree with how you are sharing your information.
As used in these Terms of Use and our Privacy Policy, “we,” “us,” and “our” refers to the LP and/or P2E platform in your country. The terms “you,” “your”, “yours” and “user” refer to you as the individual or organization accessing or using these sites.
IN SIMPLE TERMS: CONDITIONS TO USE THE LEARNING PASSPORT/ PASSPORT TO EARNING
You should read this entire Terms and Conditions, but here are some key points. By registering an account on any LP/P2E site, you accept these Terms.
- The site can be accessed by anyone with a phone number, email or Facebook account. Access to LP/P2E platform is free for all users. You will not have to subscribe or pay any fee to use LP/P2E. In order to use the LP/P2E platform, you must register for an account.
- When you register on LP/P2E, the platforms will request basic information such as your age, gender, region, grade or completed level of education etc. This requested information is unique to the country in which you are using the LP/P2E.
- If you are under the age of 13, you may only create or register an account for the LP/P2E with approval from your caregiver, or your school. Teachers or caregivers of children 13 years or younger can create an account for the child before permitting them to use the LP/P2E platforms. If teachers or caregivers are creating the accounts, LP/P2E will require the teacher/ caregiver to provide first names and last names for each child and other demographic information on the platforms
- You agree to follow rules of usage, especially not to use the LP/P2E in a harmful manner, pretend to be someone else, or jeopardize the security of the platforms in any manner
- You may use the content for educational purposes only and not for any commercial purposes. Unauthorized use of content is prohibited. Content may not be copied or reproduced in any way without the prior written permission of UNICEF. If any content is published under the Creative Commons license, you are allowed to copy and redistribute such content, but it does not allow you or others to remix or transform the content or use the content for commercial purposes. Content on the websites can be changed or updated without any prior notice
- You understand that any use of the content, website materials, software, or data through the website is at your own discretion and risk. United Nations, UNICEF, the LP and P2E disclaim any liability or responsibility arising from the use of this site or its content.
1. SITE ACCESS
You acknowledge that we may choose, but are not obligated, to make any inquiries, either directly or through third parties, deemed necessary to validate your registration information, including without limitation engaging third parties to provide verification services. LE and P2E reserves all rights to take action against anyone who misrepresents personal information or is otherwise untruthful about their identity.
2. ACCOUNT CREATION
“Users” include the children/youth using the site, their caregiver, entrepreneurs or job seekers, teachers and trainers, and any administrators using the site.
All LP and P2E websites and mobile apps can be accessed by anyone with a phone number or email account. In order to use LP/P2E, you must register for an account. You may be asked for a one-time authentication password in connection with your account that you will receive on your phone or email. All users are provided with access to content as well as specific features, based on their profile, such as learning activity and records.
When a user registers for an account, the LP/P2E requires you to enter your first name, last name and email, social media account or phone number to login. An account enables users to access LP/P2E across various devices and modalities (web or mobile app). You are solely responsible for maintaining the confidentiality of your account and password, and you agree to accept responsibility for all activities that occur under your account or password.
In addition, when you register for an account on the LP/P2E, you will be asked to provide some basic information about yourself. Examples of information LP/P2E may collect includes gender, age, grade or highest completed level of education, region etc. You warrant that all such information provided by you is accurate, current, complete, and complies with your obligations under this agreement. You also agree to maintain and update such information to keep it accurate, current, and complete.
Teachers or caregivers of young children can create an account for the child before permitting them to use the LP/P2E. If teachers or caregivers are creating the accounts, LP/P2E will require the teacher/ caregiver to provide first names and last names for each child and their demographic information mentioned above.
The LP/P2E in your country may permit you to register for the site with certain third-party platforms, social networking or integrated services, such as Facebook or Google. By registering for the LP/P2E using these third-party services, you agree that the LP/P2E may access your information to request for your name and profile picture. The LP/P2E does not store any information associated with the social media account. You may revoke the platform’s access to your account at any time by updating the appropriate account settings of the respective social media provider.
Your access to the site is personal. You are not allowed to share details of the account that has been provided to you or created by you. You are responsible for all uses of your account, even if your account is used by someone else. Sharing account details (except in the case of School Use as outlined in Section 3.4) may result in the temporary or definitive suspension of your rights to use this site.
By registering for an account on the LP/P2E or otherwise using the platforms, you represent that (i) you are at least 13 years of age, or (ii) you are of legal age of consent to open an account under the laws of your country of residence, or (iii) your use of the LP/P2E has been approved by your caregiver, or by your school or teacher for school use.
If you have any reason to believe that your account is no longer secure – if your password has been stolen, for instance – you should change your password as soon as possible. If you cannot access your account to change your password, notify us at [email protected].
3. USE OF THE SITE
3.1 Caregivers of children below the age of 13
If you are the caregiver of a child interested in using the LP/P2E, you may register for an account using one of the login modalities on their behalf. You can use any content on the platforms available to you. In doing so, you approve or consent to the registration of, or otherwise assume responsibility for any young child user; you represent and warrant that you are the child user's legal caregiver; and you agree to be bound by the terms on behalf of the child user, including without limitation being liable for all use of the LP/P2E by the child user. We advise caregivers who permit their children or students to use these platforms that it is important that they communicate with children about their safety online.
User must keep in mind that LP/P2E cannot guarantee the accuracy of any information submitted by any user and is not obligated to verify the identity of any user, including any user's claim to be a caregiver user. Any user account may be terminated by the LP/P2E at any time and without warning for any failure to abide by these Terms.
3.2 Older children and young people, including entrepreneurs and job seekers
If you are at least 13 years of age, you may register for an account on LP/P2E using one of the login modalities. You can use any content on the platforms available to you. You agree to comply with and are responsible for ensuring compliance with all local laws, regulations, and rules in the jurisdiction in which you reside or access the LP/P2E.
3.3 Children under the age of 13
If you are under the age of 13, you may only create or register an account for the LP/P2E with the approval from your caregiver, or from your school as provided in Section 3.4 ("School Use"). Children who are using LP/P2E should be made aware by their caregiver of the potential risks to them and of their obligation to comply with the Terms of Use when using this site. Children may use the LP/P2E if registered by educational organizations, by government partners, or by school personnel that have entered a relationship directly with UNICEF and/or the LP/P2E. We will do our best to assess any possible risks to children from third parties when they use this site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in light of those risks. For children under the age of 13, the email address or phone used for registration should be that of their caregiver or teacher.
3.4 School or Organizational Use
Certain schools, training institutions, or civil society organizations (CSO) may use the LP/P2E to provide content to support education- or skilling-related activities. This includes enabling teachers/trainers, school leaders, aides, ICT officers, or similar personnel to work with children and/or youth to create personal or shared accounts for children and youth on their behalf.
In some cases, selected school officials/ teachers/ trainers /organizational staff may be provided with administrator privileges for groups of users (such as a school or a class) to check metrics on course enrollment and assessment scores and evaluate student progress (see section “For Administrators”). Schools and organizations using the LP/P2E may not share any user information with any third parties.
If you are an entity, organization, or company using the LP/P2E for your members or employees, the user registering for an account accepts these Terms on your behalf.
4. RULES OF USAGE
In each country, the LP/P2E aims to create an environment where any user feels comfortable, no matter their nationality, gender, cultural background, religion, sexual orientation, or political conviction.
As an administrator and a user, you agree to use the relevant platform only for lawful purposes, and in a manner that does not infringe the rights of or restrict or inhibit the use and enjoyment of such platform by any other user.
By agreeing to the terms of service, you agree to:
- Not to defame, abuse, harass, stalk, threaten or otherwise violate the legal, moral, or human rights of others (such as rights of privacy and publicity)
- Not use the platforms in a manner harmful, fraudulent, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, or otherwise objectionable
- Not imitate, impersonate, or pretend to be somebody else. In cases where teachers or education providers are creating or managing use for multiple users, they may not ask or expose any person’s personally identifying information, contact information, or passwords without that person’s express consent
- Not jeopardize the security of your account or of the platforms in any way, such as allowing someone else access to your account or password
- Not use the LP/P2E in a manner that infringes another's intellectual property rights, rights of publicity or privacy, or other rights
- Abide by all laws and regulations applicable to you
- If you are allowed to post comments on content, please be respectful! Remember that everything you post is public. You are given the option to share your opinion on the LP/P2E, but if you post things that are not nice, such as personal attacks, harsh language or things that are mean, LP/P2E retain the right to delete them immediately.
5. CONTENT
LP/P2E in each country provides educational and skilling content and support materials, including documents, workbooks, videos, games, and quizzes to help users deepen their knowledge across a variety of topics. Content on each LP/P2E is curated by education and skilling experts in each country.
If you choose to produce and provide any original content to the LP/P2E in your country, you are agreeing to give a perpetual, world-wide, sub licensable and royalty-free license to UNICEF to use, reproduce and edit the content, to support its work and mission, and that the LP/P2E may share your content for use on the platforms in other regions or countries. Additionally, LP/P2E may include the reference to your authorship in the content. If you would not want to grant this license, please do not share content.
You understand that LP/P2E cannot control all content that is posted on this site. Occasionally, content that does violate our Terms of Use may appear on our site. You agree that when you are exposed to content which does not conform with our Terms of Use or that you otherwise find objectionable or offensive that we are not responsible for such incidents. If you see any content that violates our Terms of Use, please email us at [email protected].
UNICEF reserves the right to remove any content that is not in accordance with these Terms of Use of which we become aware of but will be under no obligation to do so. Nothing in these Terms of Use or the Creative Commons license limits or reduces a third party’s intellectual property rights. You may not use these materials to label, promote, or endorse any product or service. You are solely responsible for any violation of a third party’s intellectual property rights caused by your misuse of these materials.
5.1 Use of content
You may only use the content available on the LP/P2E:
- For educational/ skilling purposes. You shall not use or distribute the content for commercial purpose such as sale, rental, exchange for a fee, support advertisements, sponsorships, or any kind of promotions.
- Users may only access and use the content resources on this site. You may not transfer the content or resources to another person or "mirror" the content or resources on any other server.
- Any use of the content, other than as explicitly permitted in this paragraph, is unauthorized and may be a violation of copyright or other proprietary rights.
5.2 Links to external sources
Each platform may include links to other websites that are not under LP/P2E’s control. The LP/P2E provide these links merely as a convenience and the inclusion of such links does not imply an endorsement or approval by LP/P2E of any website, product or service. LP/P2E have not reviewed all the other sites and we cannot guarantee that they are always accurate or reliable. The LP/P2E do not assume any responsibility or liability in respect of such websites, including, for example, responsibility or liability for the accuracy or reliability of any information, data, opinions, advice or statements made on those websites.
5.3 Virus protection
While the LP/P2E team attempts to test the platform and its content, 100% virus free is not guaranteed, thus we encourage you to run an anti-virus program on your device, especially when downloading materials or opening email communications.
5.4 Intellectual property rights
The UNICEF, LP and P2E name and emblem (including all localized names used for the LP/P2E in countries included in Annex 2 of the Privacy Policy) are the exclusive property of UNICEF. They are protected under international law. Unauthorized use is prohibited. They may not be copied or reproduced in any way without the prior written permission of UNICEF. All other trademarks, service marks and logos used on this site, with or without attribution, are the trademarks, service marks or logos of their respective owners. Unauthorized use is prohibited.
UNICEF, LP, P2E, or their partners, own and retain all rights in and to the design, functionality, and architecture of LP/P2E, and any software, support materials or content provided through this site (collectively the “Learning Passport IP/ LP IP” or “Passport to Earning IP/ P2E IP) and are protected by copyright, patent and/or other proprietary intellectual property rights under national and international law.
Except for any rights explicitly granted under these Terms of Use, you are not granted any rights in and to any LP/P2E IP. If you want to use the IP in a way that is not allowed by these Terms of Use, you must first contact the LP/P2E team and get permission.
For third party content, UNICEF has either explicitly gained permission to use third party content or is under a Creative Commons license such as CC-BY. CC-BY-SA, CC-BY-NC or CC-BY-NC-SA. This license allows you and others to copy and redistribute the content on this site, but it does not allow you or others to remix or transform the content or use the content for commercial purposes.
You will not reverse-engineer, decompile, disassemble or otherwise access the source code for any content available in the site or software that may be used to operate this site. You will not remove any copyright, license or other notices on any resources or otherwise on this site.
You may only download content that is explicitly marked as downloadable for offline use.
6. FOR ADMINISTRATORS
6.1 Overall responsibilities
If you are school personnel or an LP/P2E Administrator, you understand that you are responsible for providing notices and obtaining consent, as may be required by applicable laws, for students to use digital platforms in your country. Administrators play a very important role in management of LP/P2E in each country and must agree not to attempt to violate the security of the platforms.
6.2 Content addition and administration
In some countries, teachers, local education officials and other partners may be requested to add content to LP/P2E deemed relevant for users in that country. Teachers will either be provided administrator rights to add content to the platforms on their own or be requested to submit content to a local administrator to upload to the platforms. Administrators for LP/P2E in each country are responsible for adding content that has been explicitly produced by UNICEF for LP/P2E or content that are trademarked by third parties. Administrators represent, warrant, and agree that they possess all rights necessary to provide any content being uploaded, and grant LP/P2E the rights in these Terms.
Before adding content, administrators should conduct quality checks and ensure the content aligns with our values and principles.
In addition, administrators for LP/P2E will not:
- add any content or material on their website that in any way promotes bigotry, discrimination, hatred or violence against any person or group; use sexually explicit or other graphically violent material; or provide instructions on how to commit any illegal or unlawful activity;
- publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information;
- upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy) unless you own or control the rights thereto or have received all necessary consents; the LP/P2E in each country reserves the right to delete any material posted to this site without notice to users;
- assert any patent infringement or other intellectual property infringement claim regarding any content you have used or submitted on the LP/P2E.
6.3 User management
Administrators are responsible for managing users on the platform including creating groups of users, updating their profile field information (if requested) and assigning content to different types of users. Different types of administrators can be assigned on the platform – course administrators who can only manage their individual courses, group administrators who manage individual groups and global administrators who are responsible for overall management.
Administrators must agree not to spam any users with promotional offers or content not related to our mission or post viruses or malware.
A few select administrators from Government agencies and civil society partners will have access to the LP Platform and data contained therein. The latter are responsible for ensuring that only authorized persons will get access to the LP and/or PE. Such administrators commit to adhering to the internationally recognized principles with respect to any processing of personal data as outlined in UNICEF’s Policy on Personal Data Protection.
7. DISCLAIMER
The United Nations, UNICEF, Learning Passport and Passport to Earning disclaim any liability or responsibility arising from the use of the platforms or the related content. The United Nations, including UNICEF, its officials, employees, consultants, agents and contractors, will not be liable for any financial or other consequences whatsoever arising from the use of the platform and related content, including the inappropriate, improper, or fraudulent use of such content.
UNICEF accepts no responsibility or liability in respect of the conduct of any user in connection with the platforms, or for any material submitted by users and carried on the platforms, including, for example, responsibility or liability for the accuracy or reliability of any information, data, opinions, advice or statements made in such material. Some external content on the LP/P2E is provided “as is”. This simply means that we cannot guarantee that everything you find on the platforms will be completely accurate or error-free. LP and P2E administrators can also periodically add, change, improve, or update the content on the platforms without notice.
UNICEF does not warrant that the functions contained in the content or resources on the platforms will be uninterrupted or error-free, that defects will be corrected, or that the platforms or the servers that make it available are free of viruses or represent the full functionality, accuracy, reliability of the content or resources. No representations or warranties of any kind concerning the platforms are given, including responsibility for any infection by virus or any other contamination or by anything which has destructive properties. LP/P2E sites and apps may have some features that are new or experimental and may not have been tested in any manner.
You understand that any use of the content, website materials, software, or data through the platforms (both sites and apps access) is at your own discretion and risk. You agree that you are solely responsible for any issues that you may encounter that result from your use of the platforms. Under no circumstances can UNICEF be held responsible for any damages or injuries you may have related to your use of the platforms.
You agree to indemnify, at your own expense, UNICEF, its officials, employees, consultants and agents, against any claims, including their costs and expenses, by any third party, relating to or arising out of (a) your use or attempted use of the platforms, resources or services in violation of this Terms of Use; (b) your violation of any law or rights of any third party; and (c) any user content that you post or otherwise make available on the platforms or through any service, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.
The mention of names of specific companies or products on the platforms does not imply any intention to infringe proprietary rights, nor should it be interpreted as an endorsement or recommendation on the part of UNICEF.
The use of particular designations of countries or territories or maps on the platform does not reflect a position by UNICEF on the legal status of such countries or territories, of their authorities and institutions or of the delimitation of their boundaries.
8. TERMINATION; WITHDRAWAL OF RESOURCES
You agree that we may terminate your use of this site, in our sole discretion, for any reason or no reason, and that we shall not have any liability to you for any such action. Without limiting any of our other rights or remedies, it is our policy to terminate in appropriate circumstances users of this site who are repeat copyright infringers. We will not be required to provide you any service or engage in any activity if we believe that the service or activity may violate any applicable law or regulation.
You further acknowledge that for the purpose of the platforms your sole relationship with us is as defined in these Terms of Use. You agree that we have the right to cancel or modify the platforms at any time, including, without limitation, the right to withdraw or modify resources or content. You acknowledge that other users also may withdraw resources or content, including resources or content you are using.
If you want to delete your account from the platforms, you need to send an e-mail to [email protected]. The rights granted to you under these Terms of Use will terminate upon any termination of your right to use the platforms, but the other provisions of this Terms of Use will survive any such termination. In some cases, schools or teachers may terminate a user’s account by contacting us or by using the administrator interface. Similarly, a caregiver may terminate a child’s account by contacting us.
While your account will be deleted, we may not be able to delete information associated with this account in all instances, such as information retained on course and lesson usage. However, we will take all necessary steps to not use such records for future analysis.
9. PRIVILEGES AND IMMUNITIES
Nothing in or relating to these Terms of Use, the Privacy Policy or the platforms shall be deemed a waiver of any of the privileges and immunities of UNICEF under the Convention on the Privileges and Immunities of the United Nations, or other local or international law.
