Highlights

The conceptual framework and questions developed for this legal review resulted in findings, conclusions and recommendations that informed the wider Regional Situation Analysis on Children Affected by Migration in ASEAN Member States. By looking at whether laws require the best interests of the child to be a primary consideration in immigration processes; whether laws permit or prohibit the immigration detention of children; to what extent children affected by migration are integrated into the national child protection system; whether national laws recognise child asylum-seekers and refugees; to what extent national laws protect every child’s right to a nationality and other important avenues of enquiry, the review delves deep into the legal and policy frameworks that underpin so many of the issues affecting children in the context of migration in ASEAN.
