保护儿童免受暴力、剥削和虐待

进入拘留所后，儿童的基本权利通常会受到严重侵犯。逮捕、拘留和审判通常是强制进行的，有时甚至是违法的，这一结果系警察或军事系统所执行的法庭职权以外的诉讼程序所造成，不存在公民保护。被拘留的儿童可能还不满承担刑事责任的年龄，且和成年犯人关押在一起，他们可能会遭到成年犯人的虐待。
大多情况下，拘留所的生活条件颇为糟糕且不人道：没有取暖设备，没有充足的食物，没有足够的床铺、满是虱子的被子、卫生设施差，无法进行体育锻炼。一些孩子还长期被单独关押。肉体上的虐待是家常便饭，所受到的伤害包括：骨折、手部骨折、耳膜破裂、挫伤以及折磨和审讯所导致的严重精神创伤。
儿童还经常会受到性虐待。父母通常没有探视权，不知道孩子的去向。孩子被拘留致使家人极度痛苦，因而使得家庭遭受到毁灭性的打击。
- 全世界有100多万名儿童被执法人员剥夺了自由。
- 多数被剥夺自由的孩子都被逮捕或者等待审判。在卢旺达大屠杀结束6年之后，仍有4454名儿童在监狱里等待对他们的判决。在这些儿童中，有450名已被明确认定没有参与屠杀。（截止2003年6月，只有196名儿童被释放。）
- 多数遭到拘留的孩子都没有严重的罪行。相当一部分孩子甚至没有犯罪行为。他们被剥夺了自由，仅仅是因为一些被称作是“地位冒犯”的行为，比如：流浪、乞讨、吸烟、逃学或者饮酒。还有一些儿童是因为随同父母前往拘留所，或是寻求前往他国避难。一些孩子因为种族、宗教、国籍、民族或政治观点的不同而遭到监禁。
越来越多的人认识到因为同法律发生冲突而剥夺孩子的自由往往是不必要的，甚至是不利的。事实上，很多接触过被拘留孩子的专家都已承认说：虽然不能说全部孩子都不应该被拘留，但可以说很多孩子不应该受到这样的对待。
