Component 6 - Review of legislation on social protection and inclusion system in Bosnia and Herzegovina

The review of applicable laws on social protection and inclusion system in Bosnia and Herzegovina will allow a review of administrative and legal obstacles to exercise the rights of the most vulnerable categories to social welfare and prepare guidelines for the implementation of the law. This will upgrade the capacities of the social protection and inclusion system to promote, protect and exercise child rights. The state and entity laws contain broad provisions for service provision and responsibility in the sphere of education, health and social welfare. However, without the accompanying by-laws, secondary legislation or Books of Rules, their implementation still poses a challenge for Bosnia and Herzegovina. Secondary legal mechanisms are necessary to develop proper procedures and structures for the implementation of strategies and laws.

Although some reviews of applicable legislation were carried out for certain sectors, there were no comprehensive reviews of applicable and draft laws, while recommendations for development of by-laws, decisions and Books of Rules were not collected.


Expected outcomes:  Decision makers propose changes to laws, in order to remove the obstacles that lead to a failure to meet requirements of marginalized children and their families
