Under the Project “Strengthening the Social Protection and Inclusion System for Children in Bosnia and Herzegovina“, UNICEF BiH aims at contributing to the protection and social inclusion of children. In this context, UNICEF is seeking to engage an agency to conduct three comprehensive Studies:
1. A study of the situation of vulnerable children and the policy and strategy context supporting delivery of social and inclusion services for children; and
2. Functional Review Study of roles, responsibilities and accountabilities for protection and inclusion services within health, education and social assistances sectors as well as cross-sectoral function and linkages supporting delivery of social protection and inclusion of children BiH.
3. Quantitative research on the perceptions and attitudes among service providers and beneficiaries of services.

1. Study on the situation of vulnerable groups of children, and policy framework and strategies supporting the services for social protection and inclusion of children in BiH
The study consists of two main components:
1.1: Situation analysis of the status of vulnerable groups of children (categories of vulnerability of children were defined by the working groups of the Project) and families with children.
1.2: The analysis of strategies, policies and legal framework that supports the services for the protection and inclusion of children, with an emphasis on inter-sectoral cooperation (integrated approach) between the system of education, health, social protection and special protection of children. The purpose is to identify good practices and gaps in the existing forms of protection and inclusion of children.
2. Study of the functions in the Social Protection and Inclusion System for children in BiH
The study includes three components:
2.1: Situation analysis of functions in individual sectors and between sectors based on the general functional categories and the goals for children prescribed in the laws and policies
2.2: Research and analysis of functions at the level of service providers (community)
2.3: Analysis of the links between the functions and mechanisms of cooperation between the sector of social protection and inclusion, and the sector for development and economic planning.
3. Quantitative research of the perceptions and attitudes among service providers and beneficiaries of services
Based on the findings of gaps and good practices in the field of strategy and policy and based on the functional reviews of the sector and cross-sector cooperation in the sectors in charge of protection and inclusion of children, the study foresees the implementation of 3 pieces of research as follows:
3.1. Research among service beneficiaries of the existing system of social protection and inclusion of children, with a focus on disabled children and their families, their perceptions, rights and claims (PRC in relation to the content, quality and capabilities of integrated services of social protection and inclusion of children in BiH.
3.2.Research about the perceptions, attitudes and practices (PAP) of service providers involved in the sectoral and integrated approaches to social protection and inclusion of children (about the existing conditions, gaps, positive practices, possible directions of development of integrated systems of protection and inclusion of children in BiH). This component will also include a research on the capacities for the implementation of an integrated approach for the protection and inclusion of children among decision-makers and service providers
3.3. Case studies - documenting the examples of good practice of an integrated approach to social protection and inclusion of children in BiH.

Required expertise / Criteria for the selection of consultants:
The criteria for selection of research agencies/companies that will be taken into consideration are as follows:
1. Prior experience in the development of similar studies;
2. Experience of the team of experts
3. Knowledge of the functions in the system of social protection and inclusion of children in Bosnia-Herzegovina – including at entity level;
3. Budget proposed
4. Timeframe proposed.
A potential bidder shall have the right to prepare and bid e for all three TORs or for individual components of the research or individual TORs. Project: Strengthening the Social Protection and Inclusion System
for Children in BiH
I - Study on the situation of vulnerable groups of children, the policy framework and strategies supporting services for social protection and inclusion of children in BiH.
1. Introduction
The project Social Protection and Inclusion System for children in BiH is aimed at strengthening the capacities for improving the system of social protection and inclusion of children and families in Bosnia-Herzegovina. The focus of the Project is on the development and implementation of integrated approaches to social protection and inclusion of children.
In the component which refers to the protection of children and families with children, the project aims at contributing to the objectives planned in the documents for the development of BiH, including the Social Inclusion Strategy (SIS) and the Country Development Strategy (CDS). This includes the development of a fiscally sustainable and effective network of social security and the establishment of a harmonized, properly targeted, efficient and sustainable system of social protection of children. The SIS for Bosnia and Herzegovina is currently being prepared.
The starting point for the development and implementation of an integrated system of protection and inclusion of children are the policies and strategies at different levels. The current policies and strategies, although of good quality, do not provide the links in relation to contents as well as between defined measures and other strategies in various sectors. This is particularly the case in relation to integrated (inter-sectoral) approaches for the protection and inclusion of vulnerable children and families with children.
2. Purpose
Based on clearly defined criteria for exclusion and vulnerability, the study intends to analytically link the measures and programs defined in various policies, strategies and laws, and to define clear recommendations for the improvement of policies and laws. This will contribute to develop and strengthen the inclusive system of integrated child protection.
The study consists of two main components:
Component 1: Situation analysis of the status of vulnerable groups of children (categories of vulnerability of children were defined by the working groups of the Project) and families with children.
Component 2: The analysis of strategies, policies and legal framework that support the services for the protection and inclusion of children, with an emphasis on inter-sectoral cooperation (integrated approach) between the system of education, health, social protection and special protection of children. The purpose is to identify good practices and gaps in the existing forms of protection and inclusion of children.
3. Tasks and expected results
3.1. Development of the study framework and preparation work

3.2 Component 1: Situational analysis of the status of vulnerable groups of children (categories of vulnerabilities of children defined by the working groups of the Project) and families with children:
-Preparation of the final format of situational analysis in cooperation with project partners;
-Collection of publications, research, documents, policies and strategies and the development of documents on the level of BiH, RS, Federation of BiH and the Brčko District, and, where appropriate, from the level of cantons, which will serve as the basis for situation analysis;
-Preparation of the working version of the situation analysis;
-Organization of the consultative process with the project partners;
-Preparation of the final version of the situation analysis.
3.3 Component 2: The analysis of strategies, policies and legal framework that support the services for the protection and inclusion of children, with the emphasis on inter-sector cooperation (integrated approach) between the system of education, health, social protection and special protection of children for the purpose of identifying good practices and gaps in the existing forms of protection and inclusion of children.
- Preparation of the final format of this component of the study in cooperation with project partners;
- Collection of policy documents, strategies, laws and development of documents that relate to the sector of health, education, social protection and special protection of children at the level of BiH, entities and at the level of cantons, where possible;
- Preparation of the first draft of the analysis for the Federation of BiH, Republika Srpska and the Brčko District and for the BiH level;
- Organization of dissemination and consultations with members of the working and expert groups of the Project;
-Preparation of the final version of the analysis.
4. Methodology:
4.1. The preparation of the study will be based on the review and the synthesis of analyses, research studies, existing data and strategies, policies and laws. The study aims to provide the synthesis of existing documents from the perspective of an integrated approach toward protection and inclusion, and to provide references to documents on the basis of which the synthesis is made.
To ensure the availability of documents that will be used for the synthesis, the Consultant will collect and consolidate existing documents. These documents will include: The strategy of social inclusion of BiH-Draft; Development Strategy of BiH - Draft; Revised BiH Action Plan for Children 2002-2010; Strategy for the Roma of BiH and four action plans (employment, education, housing and social and health care), the Action Plan for Children with special needs, the Policy on Disability; Strategic directions in the development of education; Strategy to combat violence against children; Strategy and resolutions on juvenile delinquency; Report of BiH for the Committee for Children of the United Nations; Strategy on the health of young people; Strategy - children in institutions and children at risk of separation from family; Action plan for inclusive education for children with special needs, other strategies and policy documents and laws, and working documents and analyses of the laws and policies available to UNICEF and partners.
An integral part of the study is also the electronic database of documents: research studies, analyses of the systems, policies, strategies and legislation in BiH, Republika Srpska, Federation of BiH and Brčko District.
4.2 The study is focused on the analysis of existing mechanisms of inter-sectoral cooperation and recommendations for the development of such cooperation mechanisms (integrated approach), where necessary.
In consultation with partners, the consultant will collect information on existing examples of integrated approaches to child protection, including but not limited to: an integrated approach (referral) for the prevention of violence against women and children, an integrated approach to early child development (pilot), an integrated approach to educational inclusion of children at the community level, integrated approach to youth health, integrated access to child protection, etc. The Consultant will carry out a mapping, review and analysis of the current approaches.
4.3. In all chapters, the structure of the study will address questions at the level of the Federation of BiH, Republika Srspka and the Brčko District, with a consolidated, analytical document at the level of BiH.
4.3.1 The Consultant will propose a structure (format) of the study that would best respond to the complexity of the task.
4.3.2. In preparing the draft structure of the study, the format of the Joint Memorandum on Inclusion (JIM) EU shall be used. This will be used as a template for further elaboration of the structure of the study.
4.3.3. Proposed structure of the Study
The study shall include: Introduction, Chapter-I (Component 1 – Situation analysis of the status of children), Chapter-II (Component 2 - Analysis of policy framework) and a Closing Chapter. See Annex A for more details on the proposed structure. The Consultant may propose a different structure of the Study, if necessary.
4.5. Consultations:
The Consultant will ensure a continuous advisory and consultative process with key experts from the relevant local institutions at the level of the entities and Bosnia and Herzegovina.
The Consultant will closely and regularly consult with members of management committees, working and expert groups of the Project, in their full composition, or with individual members. The Consultant will prepare the final version of the study after the consultations and approval of consulted partners.

Given the complexity of the study, the consultant is invited to set up a mixed team of at least three experts in: 1) legislation / legal review and analysis, 2) the development and analysis of policies and programs, and 3) monitoring and evaluation.

TOR I - Proposed Structure of the Study
INTRODUCTION
CHAPTER I - Situation analysis of the status of vulnerable groups of children and families with children
This chapter shall cover the following vulnerable groups of children:
Children from families with more children, children with special needs; Roma children and minority children; minors in a situation of unresolved family relations; children in conflict with the law, children victims of organized crime (pornography, pedophilia, trafficking in child organs, children trafficking); educationally neglected children, children victims of violence (in the family, on the street, in school, organized crime - begging and forced labor); children victims of abuse, exploitation and risky behavior; children returnees, children from rural areas - difficult access to all services (education, health and social services), children without parental care, children without health care, children belonging to minorities;
This situation analysis shall include the following chapters:
1. Definition of vulnerability and exclusion and the excluded groups of children and families with children;
2. The situation of children and families with children:
2.1Social situation and the impact on vulnerability and exclusion of children;
2.2 Economic development - economic trends and their impact on vulnerability and exclusion of children;

CHAPTER II - Analysis of the framework strategy, policy and legal framework that supports services for the protection and inclusion for children shall have the following chapters:

- Sectoral approach in the sectors of health, education, social protection, special protection of children:
- measures and activities of inclusion and protection of vulnerable and excluded children and families with children
- gaps in the existing system of measures and activities;
- Inter-sectoral approach: 1 Review of inter-sectoral (integrated) measures and activities of inclusion and protection of vulnerable and excluded children and families with children 2. gaps in the existing inter-sectoral (integrated) system of measures and activities;
- Analysis of the role of the non-governmental and the private sector.
2. Child protection and inclusion in the local community:
Inter-sectoral approach in the local community;
- Partnership of the government and public institutions, users, NGOs – engagement/inclusion of the whole community (child-friendly communities);
- Strengthening services in the local community;
- Action plans for the development of child protection and inclusion in municipalities (experiences of pilot municipalities).
3. Key challenges:
- Development of inclusive and integrated system of children and family protection, prevention of generational circle of poverty toward the policies that treat the development and protection of children as an investment in human capital;

CONCLUSIONS AND RECOMMENDATIONS
• Proposed measures / action plan in response to key challenges of vulnerable and excluded children and assessment of their complementarities with the priorities, activities and measures listed in the Social Inclusion Strategy of BiH, the Country Development Strategy and the Acquis Communautaire criteria (hard and soft criteria)
• Proposed measures and activities to strengthen inter-sectoral links between the sectors of health, education, social protection, special protection of children and other relevant sectors. These measures will be related to strategies, legislation, and policies. (Recommendations related to legislation will be elaborated in a separate analysis - the study will list the legal documents at stake to strengthen inter-sectoral linkages).

II - Study of the functions in the Social Protection and
Inclusion System for Children in BiH
1. Introduction
The project Strengthening social protection and inclusion of children is a 3-year project that aims at contributing to the creation of a sustainable fiscal and effective system of social protection and social inclusion for children and families in Bosnia-Herzegovina (the full description of the project is available upon request from UNICEF BiH).
The specific objective of the Project is to support the institutions of BiH to project, pilot and replicate the integrated strategy of social protection and social inclusion.
The project envisages enhanced integration and cooperation of several sectors of social protection of children, with an emphasis on the health sector, education, social protection and special protection of children. One of the project goals is therefore to develop capacities to respond to perceived gaps in the interaction and the creation of inter-sectoral cooperation between these sectors. Analysis conducted so far has shown that there are gaps and limited capacity in the vertical structure of roles, competencies, responsibilities and activities in certain sectors and that there are significant gaps in the inter-sectoral, horizontal structure of roles, competencies, responsibilities and activities.
2. Purpose
The purpose of the research is to contribute to support policymakers in providing clear recommendations to address functional gaps (roles, responsibilities, activities and competencies) in the reform of social protection and inclusion of children at different levels of the government.
The study of functions (roles, responsibilities, competencies and activities) in the system of social protection and inclusion of children in BiH is prepared with an aim to identify deficiencies in the mechanisms for establishing cooperation between departments/services in order to enhance their integration.
The study shall have three components:
Component 1: Situation analysis of functions in individual sectors and between sectors based on the general functional categories and the goals for children prescribed in the laws and policies
Component 2: Research and analysis of functions at the level of service providers (community)
Component 3: Analysis of the links between the functions and mechanisms of cooperation between the sector of social protection and inclusion, and the sector for development and economic planning.
3. Tasks and expected results
3.1. Preparation phase – development of the structure / format of the Study
3.2. Component 1:
3.2.1. Analysis of the roles, responsibilities/implementers, activities and competencies in the sectors and between the sectors of health, education and social protection and special protection of children in BiH, entities – the Federation of BiH and Republika Srpska, and the Brčko District.
3.2.2. Preparation of the structure and the analytical matrix for analysis
- Collection of relevant legislation and strategies at the level of BiH, entities and the Brčko District
- Selection of priority legislation and strategic documents on the basis of identified priority groups of vulnerable children
- Definition of generic set of functions by relevant sectors and between sectors as a framework for analysis
3.2.3 Analysis of the roles, responsibilities, activities and competencies in the sectors of health, education, social protection and special protection of children and child protection at the following levels: 1 service providers, 2 municipalities, 3. NGO sector, 4. support institutions established in the sectors (at the level of cantons, entities, BiH), 5. relevant ministries 6. other relevant institutions.
3.2.4 Analysis of the role, responsibilities, activities and competencies regarding the implementation of the inter-sectoral goals between the sectors of health, education and child protection and special protection of children (using the methodology of analytical review that is based on the review of existing strategic and legislative framework at the following levels: 1 . service providers, 2 municipalities, 3 NGO sector, 4. support institutions established in the sectors (at the level of cantons, entities, BiH), 5. relevant ministries 6. other relevant institutions.
3.2.5.. Prepare an analytical report based on the above tasks, that will include a detailed overview of the functions to the level of service provider, and recommendations for the development of research framework of the functions of service providers in communities.
Method
The consultant will review available project documentation, available functional reviews in BiH, and will conduct interviews and consultations with members of the working group of the Project and other stakeholders in the Project, as needed. The consultant will analyse the legislation and strategic documents, interviews, and will consolidate functional reviews.
Functions, ie, the roles, competencies, responsibilities and implementers of activities shall be analyzed and consolidated into the analytical matrix, which is structured along the objectives for children as defined in laws and policy frameworks and strategies.
The analytical matrix will be divided into two parts:
1. analysis of functions in the sectors according to sectoral goals
2. analysis of functions of inter-departmental cooperation and referral toward the goals that require inter-departmental cooperation (defined in the framework of policies, strategies and laws).
Functions, ie, competencies, responsibilities and implementers of activities include the following general functional categories: 1. Policy development; 2. Planning, 3. Development of sector capacities 4. Planning and management of human resources; 5. Monitoring; 6. Legislative and regulatory functions 7. Financing - planning, distribution of resources; 8. Supervision; 9. Data collection; 10. Program development and implementation 11. Implementation; 12. Coordination, contacts with other institutions (coordination, i.e. coordination mechanisms with lower and higher levels of implementation); 13. Monitoring and evaluation
In addition, the analysis will also start from the general functions related to the special protection of children: 1. Work on the ground, 2. Identification of vulnerable children, 3. Monitoring and assessment of the status, 4. Case management and provision of services, 5. Referral to other services, 6. Monitoring the case.
It is expected that the number of functions that support the achievement of strategic goals for children will get more complex at the level of service provider functional analysis. The analysis of roles, competencies, responsibilities and activities at the level of service providers shall be explored in detail under the second component of this study.
3.3. Component 2: Research and analysis of functions (roles, jurisdictions, implementer of responsibilities and activities) at the level of service provider in the sectors of health, education, social protection and special protection of children, and between sectors.
3.3.1. Preparation of the research framework:
- Mapping and selection of laws and by-laws, regulations and decisions on staffing structure and terms of reference that define the function of the service providers;
- Selection of key service providers by sectors and service providers by inter-sectoral functions - defining the scope and target groups of the research (institutions, vertical and horizontal overview of the roles between and within institutions: the management, different service providers, partners);
- Selection of samples and locations of the research in the framework 10 (+ control municipalities), municipalities in which the Project will be implemented;
- Review and structuring of existing analysis, i.e., instruments for the assessment of the situation and capacities that are developed within the framework of the Project;
- Structuring of framework questions for research and appropriate methods (legal framework, standards, capabilities, and possibility for the implementation of functions specified under laws and strategies - assessment of human and physical capacities, knowledge, skills, etc.);
- Proposal of tools and instruments for research on the basis of reviews from the point 3.2.1.4 and consultations with relevant partners.
3.3.2. Implementation of the research:
- Testing of the proposed tools and instruments;
- Coordination and organization of research in the field;
- Preparation of analytical template for the development of tools and research (task 3.1);
- Collecting, entering and analyzing the data obtained through the research;
- Preparation of the report.
Method:
Overview of the existing documentation and research methods, interviews and consultations with partners in the Project and members of the working group of the Project.
Review of the documentation, research in the field, input and analysis, consultations with members of the working group and relevant experts and partners.
3.4. Component 3: The analysis of links between the functions of social sectors and the sectors in charge of economic development planning:
3.4.1 Preparation of the analytical framework;
3.4.2 Analysis of the existing functional and strategic mechanisms, which include cooperation between the social sector and economic sector in the planning of policies and strategies at the level of BiH and the entities;
3.4.3.Development of recommendations for strengthening of the links and mechanisms of cooperation between the social sector and the sector for economic planning.
Method:
Review of current best practices, methods and analysis and proposals for the development of national sector planning, review of functions and recommendations proposed in the framework of public sector reform, review and analysis of existing practice (e.g. Development of the BiH Strategy of Social Inclusion and Development Strategy of BiH).
The analysis will be aimed at assessing the existence of functional links between the social sector and the sector for the development and economic planning, assessing the evaluation mechanisms for cooperation and the modalities of feedback and influence on the basis of which the policies and decisions in the social sector are filtered into the sector of macroeconomic planning.
3.5. Preparation of the final report of the functional review of the sectors of social protection
and inclusion of children in BiH including:
- Compilation and analytical review on the functional analysis of tasks 3.1, 3.2 and 3.3;
- Narrative and tabular overview of gaps;
- Analytical review/causal analysis of gaps;
- Recommendations for bridging the gaps (derived from the results of work tasks 3.1 and 3.2 and 3.3.).
4. Overall methodology
4.1 The proposed methodological approaches are defined in the framework of individual tasks and are expected to be revised through interviews and consultations with working groups and project partners.
4.2 An integral part of the methodological approach will be the composition of the research team which should be multidisciplinary and include professionals in the field of law, social research, consultants in certain issues and in other relevant areas.
4.3. Revised project tasks will be prepared if the consultations with our partners show that it is necessary to adjust the project tasks.
4.4. Coordination with partners will occur at different levels in order to establish the methods and results of research. This is an integral part of the methodology. The Consultant will consult experts from local institutions at the level of the entities and BiH, and members of the working and expert groups of the Project.
4.5 Research in the field will include:
- Development of tools;
- Organization of research in 10 (+ control) municipalities in Bosnia and Herzegovina;
- Set up of the research team for qualitative research in the field;
- Coordination with project Partners in the field, including the continuing advisory role of representatives of institutions that participate in the Project.

III - Quantitative research on the perceptions and attitudes among service providers and beneficiaries of services
1. Introduction
Quantitative investigation of perceptions and attitudes of service providers and service beneficiaries will stem from the findings in studies 1 and 2.
2. Purpose of the research
The purpose of this research is to provide insight into the attitudes, perceptions, requirements of service beneficiaries and service providers of protection and inclusion of children in BiH to develop an integrated system of protection and inclusion of vulnerable children and families with children in BiH.
Based on the findings related to gaps and good practices in the field of strategy and policy and based on the functional reviews of the sectoral and cross-sectoral cooperation (in the sectors in charge of protection and inclusion of children), the study foresees the implementation of three pieces of research as follows:
2.1. Research among service beneficiaries of the existing system of social protection and inclusion of children, with a focus on disabled children and their families, their perceptions, rights and claims (PRC) in relation to the content, quality and capabilities of integrated services of social protection and inclusion of children in BiH.
2.2.Research about the perceptions, attitudes and practices (PAP) of service providers involved in the sectoral and integrated approaches to social protection and inclusion of children about the existing conditions, gaps, positive practices, possible directions of development of integrated systems of protection and inclusion of children in BiH.
This component will also include research on the capacities for the implementation of an integrated approach for the protection and inclusion of children among decision-makers and service providers
2.3. Case studies - documenting the examples of good practice of an integrated approach to social protection and inclusion of children in BiH.
3. Tasks and expected results
3.1. Research I - among service beneficiaries of social protection and inclusion of children includes the following tasks:
3.1.1 Preparation of the research framework:
- Collection and review of existing representative research studies;
- Analysis of preliminary results of the Functional Review Study and action planning of the referral system planned by the Project for the purpose of identifying the research domains (based on preliminary findings of Study 1 and 2);
- Overview of the rights prescribed under the law and policy frameworks and strategies related to services of social protection and inclusion of children for the purpose of identifying the research domains;
- -Preparation of questionnaires for quantitative research;
- -Development of the research sample.
3.1.2 Implementation of the research shall include:
- Testing of the proposed tools and instruments;
- Coordination and organization of research in the field;
- Collecting, entering and analyzing data obtained through research;
- Preparation of the report.
Method: Review of existing materials and research in Bosnia-Herzegovina and beyond, interviews, consultations.
3.2 Research on the perceptions, attitudes and practices (PAP) of service providers
3.2.1 Preparation of the framework/structure of the research:
- Collection and review of existing representative research studies;
- Analysis of the preliminary research results from Study 2 (functional review) and action planning of the referral system planned by the Project for the purpose of determining the research domains (based on preliminary findings of Study 1 and 2);
- Data analysis related to capacities of service providers (knowledge, skills, equipment, needs) collected within the Project;
- Overview of the rights defined by the law, and the framework of policies and strategies related to services of social protection and inclusion of children for the purpose of defining the domain of the research;
- Preparation of questionnaires for quantitative research;
- Determining the sample for research.
Method: Review of existing materials and research studies in Bosnia-Herzegovina and beyond, interviews, consultations.
3.2.2 Implementation of the research shall include:
- Testing of the proposed tools and instruments;
- Coordination and organization of research in the field;
- Collecting, entering and analyzing data obtained through research;
- Preparation of the report.
3.3 Case studies
Documenting examples of good practice of an integrated approach to social protection and inclusion of children in BiH.
In cooperation with the project working groups:
- Select examples of good practice and integrated system of social protection and inclusion of children at the community level (providing of services);
- Define the format/structure of the case studies;
- Prepare case studies (a maximum of 10 studies);
- Ensure consultation with partners.
4. Overall Methodology
Quantitative research shall be representative of Bosnia and Herzegovina.
The sample includes up to 1.000 respondents - service beneficiaries, and to 1.000 respondents - service providers;
Questionnaires for the research will be developed based on: 1) existing examples of research where this is possible, 2) analysis of existing findings in the Project and outside the Project regarding the opinions, attitudes and capacities, and 3) consultation with the entities and partners of the Project;
Quantitative research of service provides shall have two dimensions: the collection of data on the perceptions, opinions and attitudes, and data on current capacities (knowledge, skills, equipment, personnel, etc.) regarding the possibility of the implementation of an integrated system of protection and referrals.
Preparation and implementation of research requires mixed teams of experts, with close consultation with representatives of relevant institutions in BiH and its entities.
